The present document contains the “Terms and Conditions” applicable to the access and use of the services offered by INDESSIN PHOENIX (Indepho) and his commands (URLs) related. The User has to read, understand and accept all the here established conditions previous to his register like User, to the acquisition of products/services, to the delivery of any data,

Field of Application

The present terms, conditions and privacy policies (from now on, "Document") regulate all the acts, agreements and commercial relations celebrated go in:

  • INDESSIN PHOENIX (Indepho), with RUC 20603943946 (from now on, "the Company", "the Provider" or "the Company Oferente"); and

  • The users, clients or any person that use the services of INDESSIN PHOENIX (Indepho) or his platforms associated (from now on, "the User" or "the Clients").

This Document applies also to any filial society, coligada or commercial ally that operate under the mark INDESSIN PHOENIX (Indepho) or in collaboration with us, which will govern by these same terms except pact express in contrary.

Consent and Acceptance

When using the services of INDESSIN PHOENIX (Indepho), the User accepts:

Clear Definitions

To avert ambiguities, establishes that:

  • "INDESSIN PHOENIX" or "Indepho": it Is the commercial mark and company title of these services.

  • "Services": they Include, but they do not limit to: I develop web, development of software to measure, technological consulting, digital design, hosting and any another service offered by INDESSIN PHOENIX (Indepho).

  • "Subsidiaries or Coligadas": it refers to legal linked companies or commercially with INDESSIN PHOENIX (Indepho) that operate under his same direction or control.

Legal Capacity

Hire with INDESSIN PHOENIX (Indepho) only is possible for people with legal capacity to celebrate agreements. They will not be able to use our services people that do not possess said capacity or minor of age. The acts that these last make in our platforms will be responsibility of his parents, tutors, or curadores, and will consider made by these in exercise of his legal representation. The one who register an user like company, will have to have the capacity to hire to name of said entity and oblige it under the terms of this agreement.

Your Account

When it require an account to use our Services, accept to facilitate us complete information and precise, as well as maintain it updated so that we can communicate us with you. We could send you emails on important updates (like modifications of these Conditions or of the Privacy policy) for your information.

Can limit your access to our Services until we verify the information of your account, as your email address.

Responsibility by Content and Products (in E-commerce)

The Client is the only responsible of the content, products and/or services offered in his on-line tent or platform developed by us, guaranteeing his legality (ej. Legal Fulfillment and Tributario

The Client has to fulfil with all the applicable Peruvian laws, including but not to limiting to the emission of comprobantes of valid payment, the respect to the Law of Protection to the Consumer and all normative tributaria valid. INDESSIN PHOENIX (Indepho) will not be responsible by fines, sanctions or any legal problem derived of the incumplimiento of the Client.

No Exclusivity (For Services)

Ours company offers services of web design, development of software and technological consulting to multiple clients, even if they operate in the same commercial sector. do not offer exclusivity unless firm an agreement by writing with special conditions, which will have to be signed by the legal representatives of both parts.

Statement and General Guarantee

Our aim is to do of our platform a better place, and our Services are designed to give you the control of your websites and projects. We animate you to express you with liberty, subject to some requirements. When using our Services, declare and guarantee that:

  • will act in strict compliance with this Agreement.

  • will fulfil all the laws and pertinent norms (included, among others, the laws referents to the behaviour on line, to the acceptable content, to the privacy and data protection, to the transmission of technical data, to the use or provision of financial services, to the notifications, to the protection of the consumer, to the disloyal competition and to the deceptive advertising).

  • will not use our services with illegal purposes, to publish illegal content neither to boost illegal activities.

  • No infringirás neither you apropiarás indebidamente of the intellectual property rights of INDESSIN PHOENIX (Indepho) or of third.

  • will not overburden neither will interfere in our systems, neither will impose a load injustificada or disproportionately big in our infrastructure, as we determine to our whole discretion.

  • will not reveal personal information of others.

  • will not use them to send spam or massive messages no requested.

  • will not interfere, will interrupt neither will attack any service or net.

  • will not use them to create, distribute neither enable material that was, facilitate or operate together with malware, spyware, adware or other codes or wanton programs.

  • will not apply reverse engineering, will decompile, will disassemble, descifrarás neither will treat to extract of some another way the code source of the Services or any technology related that it was not of open source.

  • will not take part in the hire, the lease, the loan, the sale neither the resale of the Services or data related without our consent.

Permission for Use of Logotype and Quotations

When hiring our services, the Client awards on purpose to INDESSIN PHOENIX (Indepho) and his subsidiaries (including but no limited to Indepho Services EIRL) the no exclusive right, free and limited to use his logotype and the quotation of his corporate mark in:

  • Our websites ([suspicious link deleted] and commands related).

  • Sections of "Clients", "Portafolio" or "Cases of success".

  • promotional Materials interns (presentations, corporate reports).

Only with the end of:

  • Identify to the Client like user of our services.

  • Ends of generic commercial promotion (without endorsamiento implicit).

Restrictions of Use:

  • Not including information of contact (emails, telephones, physical directions) without permission expresses by writing.

  • Not modifying the logotype (except adjust minimum technicians of size/format for adaptation web).

  • Not associating the mark of the Client with sensitive contents (political, religious, adults).

Application of Retreat:

The Client can request anytime:

  • During the force of the service: Sending of application written to soporte@indepho.com. Retreat in 15 deft days.

  • When finalising the service (including no renewal): automatic Retreat in 15 deft days back to the date of termination.

  • will send a notification of confirmation via email.

Guarantees of the Client:

The Client declare to be legitimate headline of the rights of the logotype or have permission to concede this permission, exempting to INDESSIN PHOENIX (Indepho) of catchwords by use authorised.

Opinion and Continuous Improvement of Our Platform

likes Us listen your opinion and always treat to improve our Services. When sharing commentaries, ideas or opinions with us, accept that we can use them freely without restrictions neither compensations for you.

Our program of continuous improvement helps us to maintain our up to date platform and to make improvements and updates without any cost or increase for our users.

Copyright

This Agreement does not transfer you any copyright of INDESSIN PHOENIX (Indepho) or of third. Therefore, all the rights, titles or relative interests to said property are (among the parts and you) exclusively of INDESSIN PHOENIX (Indepho). All the other commercial marks, marks of service, charts and logotypes used in relation with our websites or Services are commercial marks or commercial marks registered of INDESSIN PHOENIX (Indepho) or of the otorgantes of licences of INDESSIN PHOENIX (Indepho). The other commercial marks, marks of service, charts and logotypes that use in relation with our Services can be commercial marks of third. The use of our Services does not concede you the right neither the licence to reproduce or, of another way, use any of the commercial marks of INDESSIN PHOENIX (Indepho) or of third.

Cancellation

Can cancel your access to all or part of our Services anytime, with or without motive or notice, with immediate effectiveness. This includes, but does not limit to, if we believe, according to our own criterion, that have infringido this Agreement, the guidelines of the service or other applicable conditions. Have the right (but no the obligation) of:

  • (i) Demand your name of user or the URL of your place by prolonged inactivity.

  • (ii) Refuse or delete any content that, according to our opinion, infrinja any part of this Agreement or any politics of INDESSIN PHOENIX (Indepho), or was hurtful or objetable.

  • (iii) Ask you that you do adjust, restrict the resources that uses your website or cancel your access to the Services, if we think that the storage or the use of the bandwidth of your website are a load for our systems (which is rare and only is used to to occur when a website uses to share archives or for excessive storage).

  • (iv) Cancel or refuse the access or use of any one of our Services to any person or entity by any motive.

will not have the obligation to provide repayments of prices paid previously.

Can leave to use our Services anytime or, if you use a Service of payment, can cancel it anytime, subject to the section Prices, payments and and renewal of these Conditions (if it applies).
